Car crashes are the most common serious injury claims in North Carolina, and they are also the ones insurance companies are best at minimizing. They have standard software that values your injury before anyone has examined you, standard arguments about why your treatment took too long or cost too much, and standard tactics for shifting a percentage of blame onto you — which, in this state, can end your claim entirely.

What to do after a crash

  • Get medical attention, even if you feel able to walk away. Gaps in treatment are the single most common argument against injury claims.
  • Photograph both vehicles, the scene, and your visible injuries.
  • Get the crash report number and the names of any witnesses.
  • Do not give a recorded statement to the other driver's insurer before speaking with a lawyer.
  • Keep every bill, every out-of-pocket receipt, and a simple daily note of what you cannot do.

Underinsured and uninsured drivers

North Carolina's minimum liability limits are low, and a serious injury can exhaust them in a single hospital stay. When the at-fault driver does not carry enough coverage, the claim often shifts to underinsured motorist coverage — which may be available under your own policy, a household member's policy, or in some cases stacked across multiple vehicles.

Finding every applicable policy is real work, and it is frequently the difference between a case that covers a lifetime of care and one that does not. We look for coverage before we talk about settling.

Not before you know what your treatment will actually require. Early offers are made precisely because the full picture is not in yet. Once you sign a release, the claim is closed permanently — including for treatment you have not discovered you need.

What if the crash was partly my fault?

Tell us anyway. North Carolina's contributory negligence rule is harsh, but fault is often disputed, and what an adjuster asserts about fault is not the same as what the evidence shows. There are also recognized exceptions. Do not decide on your own that you have no case.
